The terms that govern use of the Systempoint website and local data tracking utility.

These Terms of Service (“Terms”) govern access to and use of the Systempoint website at systempoint.digital and the Systempoint software described on this site. By using the website or software, you agree to these Terms.

1. Acceptance of terms

If you do not agree to these Terms, do not use the website or software. Continued use means you accept the Terms in effect at that time.

2. Description of the software

Systempoint is a local data tracking utility and analytical software for manual portfolio journaling, record organization, historical review, and informational summaries.

Systempoint is not a financial institution, wallet provider, custodian, broker, exchange, investment platform, or payment provider. The application does not hold, hold custody of, or process user funds or cryptocurrency assets, does not access private keys, does not execute transactions, and does not provide financial or investment advice. All information is provided for informational and record-keeping purposes only.

3. Permitted use

You may use the website to learn about Systempoint and you may use the software for lawful personal informational, analytical, and record-keeping purposes consistent with these Terms and applicable law.

4. Prohibited use

You may not:

  • use Systempoint to misrepresent it as a financial institution or investment service
  • attempt to use the software to custody assets, process payments, or execute trades
  • reverse engineer, scrape, or disrupt the website except where mandatory law allows
  • use the site or software for unlawful, harmful, or deceptive activity
  • invent or display false Microsoft endorsements, certifications, ratings, or partnership claims in connection with Systempoint

5. Intellectual property

Site content, branding, text, and design elements are owned by Systempoint or used under permission. You may not copy or redistribute site materials for commercial purposes without prior written consent, except for ordinary personal viewing and lawful fair-use exceptions.

6. Software limitations

The software is an informational analytical utility. Features focus on organizing and reviewing locally available journal-style records. Systempoint does not guarantee uninterrupted availability, error-free operation, or suitability for any particular decision-making process.

7. Third-party services

Links to third-party sites, including https://apps.microsoft.com/, are provided for convenience. Systempoint does not control third-party services and is not responsible for their content, availability, or policies. Reference to the Microsoft Store homepage does not imply that Microsoft publishes, verifies, certifies, develops, endorses, or is affiliated with Systempoint unless independently true as a matter of fact.

8. No financial or investment advice

Nothing on the website or in the software constitutes financial, investment, legal, or tax advice. You remain solely responsible for your own decisions and records.

9. No financial institution status

Systempoint does not accept deposits, provide banking services, operate as a broker or exchange, or act as a regulated financial intermediary under these Terms.

10. No wallet functionality and no custody

Systempoint does not provide wallet functionality for holding assets, does not custody assets, and does not manage private keys on behalf of users.

11. No transaction execution

Systempoint does not execute, clear, settle, or otherwise process financial or cryptocurrency transactions.

12. Disclaimer of warranties

To the fullest extent permitted by applicable law, the website and software are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the fullest extent permitted by applicable law, Systempoint and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business opportunities arising from use of the website or software. Where liability cannot be excluded, it is limited to the maximum extent permitted by law in Thailand (TH).

14. Changes to the software

Systempoint may update, modify, or discontinue features of the software or website. Material changes that affect these Terms will be reflected in an updated version of this page.

15. Changes to the Terms

We may revise these Terms periodically. The “Last updated” date will be adjusted when changes are published. Your continued use after changes become effective constitutes acceptance where permitted by law.

16. Governing law

These Terms are governed by the laws of Thailand (TH), without regard to conflict-of-law principles that would require another jurisdiction’s laws. Courts located in Thailand shall have jurisdiction over disputes arising from these Terms, subject to mandatory consumer protections that may apply in your location.
